NGT & Environmental Matters
Pollution, environmental clearance disputes, and construction-halt matters before the National Green Tribunal's Southern Zone Bench in Chennai.
What this covers
The National Green Tribunal handles disputes relating to environmental protection, forest conservation, and other natural resources, including enforcement of legal rights relating to the environment. It has both original jurisdiction (a fresh case, e.g. a pollution complaint) and appellate jurisdiction (challenging an environmental clearance or a decision of a pollution control board).
Common matters: industrial pollution affecting a neighbourhood, construction proceeding without required environmental clearance, waste and effluent discharge violations, and encroachment on protected land or water bodies.
General process
Assess jurisdiction
Confirm the matter falls within one of the seven environmental statutes the NGT administers.
File within limitation
Applications generally must be filed within six months of the cause of action (extendable in limited circumstances).
Expert & committee reports
The Tribunal often relies on expert or joint-committee reports before deciding.
Order & compliance
Directions can include compensation, remediation, or a halt to the activity in question.
Frequently asked
Who can file a case before the NGT?
Any person aggrieved, including individuals, communities, and organisations — you don't need to show the same direct personal injury required in some other forums.
Is there a strict deadline to approach the NGT?
Generally within six months of the cause of action, with a possible extension of up to sixty days for sufficient cause. Acting quickly matters here more than in most other forums.
Can the NGT stop a construction project?
Yes — interim relief, including a stay on construction or operational activity, is a common remedy sought and granted while a matter is pending.
